To ensure this protection, the international community recognized the existence of jus cogens, peremptory norms of general international law, which bind all the countries without their separate consent . Even there is a debate on the issue of the lack of criteria to identify when a general rule of international law has reached the status of jus cogens , it is very well established under international law that the prohibition of torture is clearly one of those norms. While there is a low opposition to this idea by the states, some authors argue on the practice of torture by some of them that could contest the jus cogens status of the prohibition of torture. The legal arguments below will provide that the recognition of the prohibition of torture as a jus cogens is strongly supported by the states practice, treaty law, doctrine and judicial decisions. This recognition based on the legal conscience and moral values creates a more aware and responsive international community that reinforces the respect of human rights worldwide. Background Many European countries abolished torture in the late 1700s or early 1800s. Even after they abolished torture in the 1700s and 1800s, European countries returned to its use in the 1900s, often claiming state security reasons. Examples of states that used torture as a part of their state security are Nazi Germany and Stalinist Russia, after that the military dictatorship in Greece after World War II, France turned to torture in Algeria in the 1950s, and the United Kingdom used it at various points in Ireland. Being widely practiced throughout history, torture was one of the main characteristics of the awful abuses of the Second World War. After the war, in 1948, the General Assembly of the United Nations included the prohibition against torture in the milestone Universal Declaration of Human Rights. This declaration was followed by many international conventions prohibiting official use of torture in war and peace as the four Geneva Conventions, UN Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, International Covenant on Civil and Political Rights, European Convention for the Protection of Human Rights and Fundamental Freedoms, the African Charter on Human and Peoples Rights, and the American Convention on Human Rights. All of these international and regional conventions raised the prohibition of torture in a universally respected treaty norm of international law. During the 80s there was substantial evidence that the prohibition of torture also constituted a norm of international customary law . Nowadays, torture is absolutely prohibited under international law and is qualified as obligation erga omnes from which no derogation is allowed. How to determine jus cogens status of prohibition of torture The doctrine acknowledges that sufficient legal basis exists to identify which norms are jus cogens. This legal basis consists of the following: (1) opinio juris, the recognition that these crimes are assumed part of general customary law; (2) language in preambles or other provisions of treaties applicable to these crimes which indicates these crimes’ higher status in international law; (3) the large number of states which have ratified treaties related to these crimes; and (4) the ad hoc international investigations and prosecutions of perpetrators of these crimes. Analyzing the prohibition of torture under these legal bases brings to the inevitable conclusion that it is one of the crimes that has gained the status of jus cogens. Acknowledgement of the jus cogens status of the prohibition of torture is universal. States have made great efforts to articulate their categorical rejection of practice of torture by official authorities. According to the 1999 Initial Report of the United States to the U. N. Committee against Torture, in the United States, the use of torture is categorically denounced as a matter of policy and as a tool of state authority†¦No official of the government, federal, state or local, civilian or military, is authorized to commit or to instruct anyone else to commit torture. Nor may any official condone or tolerate torture in any form†¦Every act of torture within the meaning of the [Convention against Torture] is illegal under existing federal and state law, and any individual who commits such an act is subject to penal sanctions as specified in criminal statutes. A strong convincement can also be read in the words of the Special Rapporteur on Torture on his first report to UNHCR in 1986 â€Å"Torture is now absolutely and without any reservation prohibited under international law whether in time of peace or of war. In all human rights instruments the prohibition of torture belongs to the group of rights from which no derogation can be made†. T he amount of international and regional conventions prohibiting torture is extensive, but yet another aspect important for the universality of the recognition of this prohibition is the number of states that have ratified them. Apart from the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights (ICCPR) is ratified by 153 countries, including the United States in 1992 and the Convention against Torture or Other Cruel, Inhuman or Degrading Treatment or Punishment is ratified by 136 countries, including the United States in 1994. The language used in the conventions prohibiting torture indicates the high status of this norm in the international law. The preamble of the Convention against Torture or Other Cruel, Inhuman or Degrading Treatment or Punishment recalls on the principles proclaimed in the Charter of the United Nations. This reference to the Charter of the most universal international organization implies a high responsibility of the international community regarding the prohibition of torture. Further more the Convention not only that requests restrain from the countries regarding the practice of torture but also sets up obligation for them to take legislative, administrative, judicial or other measures to prevent acts of torture in their territory. The case law confirming the jus cogens status of the prohibition of torture is very rich in these days. One of those first cases was Siderman de Blake v Republic of Argentina where the court referring to jurisprudence and treaty law ruled that the prohibition of torture, different from the Filartiga v. Pena-Irala case confirming that torture was prohibited under customary international law, has already gained the jus cogens status. Later the International Criminal Tribunal for former Yugoslavia stated in the case Prosecutor v. Furundzija that the prohibition of torture is a jus cogens. The court stated that every State is entitled to investigate, prosecute and punish or extradite individuals accused of torture, whowhich are present in a territory under its jurisdiction. The rationing for this is that the torturer has become, like the pirate and the slave trader before him, hostis humani generis, an enemy of all mankind. Similarly in the court held in Prosecutor v Kunarac that: â€Å"Torture is prohibited both in times of peace and during an armed conflict. The prohibition can be said to constitute a norm of jus cogens†. The same status of the prohibition of torture was also recognised by Your Lordships’ House in R v Bow Street Metropolitan Stipendiary Magistrate and others, ex parte Pinochet Ugarte where Chile acknowledged that the prohibition of torture had jus cogens status. Similar opinion was expressed in Jones v Ministry of Interior of Saudi Arabia by The Lords of the Appeal, giving an extensive evidence of the widespread acceptance of jus cogens status of the prohibition of torture in treaty law, customary international law and case law, confirm the same status of the prohibition of torture. Another approach to determining the jus cogens status of the norms of general international law is the one that the International Law Commission held it is not the form of a general rule of international law but the particular nature of the subject-matter with which it deals that may, in the opinion of the Commission, give it the character of jus cogens. Even this approach grants the prohibition of torture a jus cogens status when we take into consideration factors that determine the nature of this subject–matter that derives from the importance and attention that the international community dedicates to it. As mentioned above the number of the conventions and instruments, universality of recognition and case law prove the crucial importance of this matter of general interest for the international community. The prohibition of torture should be considered having a wide scope All the relevant sources of the international law and the approaches for determining the jus cogens are very explicit in pointing towards the prohibition of torture as having the status of one of those norms. Having that clear, there is another dilemma that nowadays the international community faces, and that is the scope of acts the prohibition of torture covers. Weather coercive interrogation, apart from the one that is inhuman and degrading, a distinction from torture that can be made in theory but almost impossible to be made in practice, falls into the scope of jus cogens prohibition of torture. One great example of that is weather sleep deprivation is torture. While, there are authors that would even argue that in exceptional cases of immanent risk for lives of citizens, application of some form of physical methods that amount to torture should be allowed. Responding to that, the prohibition of torture as a jus cogens has not only a actual effect, it rather has a long-term preventive goal too, and in that sense when there is not any clear way to manage coercive interrogation institutionally so that it does not degenerate into torture , it becomes more than clear that the ban expands to a wide scope of practices that can always pose a risk to the human rights protected by this prohibition. While theoretically it may be still argued otherwise and different conclusions can be made, the prohibition of torture remains a practical universal ban on any attack or risk to human rights protected. Conclusion The prohibition of torture incorporates two important dimensions, the physical and psychological protection of every human being that relates this norm with the very fundamental right to life. This fundamental nature of the prohibition of torture raises it to very top of the interests of the international community which has made a lot of efforts for universalization of this norm. Giving it the status of jus cogens, the international community has ensured that the law that governs it provides for a lot of support through the treaties, customary law, cases and doctrine for this status of it. Having that sufficient support by the international law, the jus cogens status of the prohibition of torture will ensure that the acts of torture, wherever they occur, will not go unpunished.

Siddhartha Siddhartha has been searching for fulfillment all his life. Though he was the most scholarly and respected Brahmin, this did not satisfy him. He drank knowledge, yet still felt ignorant. He could not find peace. He could not find fulfillment. His journey is essentially one of trial and error, suffering, mistakes, and rebirth. He was the son of a Brahmin priest and gained all the knowledge he could acquire, learned and practiced the ways of the Brahmin, but found it was not for him. It did not fulfill him, so he left and became a Samana, living by not living, conquering his Self through pain, hunger and fatigue. Yet, he could not lose his Self. He could only deceive it, trick it, run away from it, and each time it returned mockingly. Because of this, he leaves the Samanas. He finds and listens to the teachings of the illustrious Buddha. He sees that Gotama has attained enlightenment, but he does not practice the ways of the Buddha for he knows that he must take his own path, find his own peace, attain nirvana on his own. So he sets out on this quest alone. Only then does he discover the error of his ways. He realizes that there is beauty in life, the world is not an illusion, but very real to him. He goes and lives among the common people in a small town where he becomes a successful business man. He learns the art of love, business, and human nature. Slowly he deters, becoming a gambler, eating rich foods, drowning himself in money and drink. He becomes more and more disgusted with himself. Finally, when he can take it no longer, he flees the town in hopes of escaping this new Siddhartha whom he despised. Feeling utterly hopeless, when he reaches a river, he longs to end his life by submerging himself in the water. As he bent down, he heard a sound from a remote part of his soul, and awoke him from the gravity of the mistake he was about to make. It was the sound Om, that saved his life and lulled him to sleep. Upon awakening he found himself changed, renewed, and reborn. He was no longer the man he recognized nor the man that his friend Govinda, who was watching him sleep, recognized. Only by losing everything did he begin to find himself. At the brink of death, where he was about to end his life, did he finally discover himself again. All these transitory things have slipped away from him, and he is once more standing beneath the sun as he once stood as a small child. Nothing is mine, I know nothing, I possess nothing, I have learned nothing... Now, when I am no longer young, when my hair is fast growing gray, when strength begins to diminish, now I am beginning again like a child, he thinks to himself, I had to become a fool again in order to find Atma in myself. I had to sin in order to live again. Whither will my path yet lead me? This path is stupid, it goes in spirals, perhaps in circles, but whichever way it goes, I will follow it. He does follow it. He follows it right to Vesudeva, the ferryman. He stays with Vesudeva and learns the ways of the river. He learned to listen openly and freely, without judgement or opinions. He learned that time does not exist, that everything has reality and presence. Living simply, but happily as a ferryman he learns from the river; it talks to him; it teaches him. In taking care of his son, and losing him, he finds love, an emotion that he once thought he was not capable of. Regardless of his son's disobedience, and lack of respect, Siddhartha loved him blindly and unconditionally. Only when his son runs away does he realize that he is his son. He, too, chose to leave his father, to find his own path, make his own mistakes, suffer from his own sins, before he finally found his path. People have been looking up, trying to explain what they see in the sky probably since the first human-like cave dwellers existed. Theres a famous scene in the movie 2001: A Space Odyssey, where a hominid named Moonwatcher surveys the sky, taking in the sights and pondering what he sees. Its likely that such beings really did exist, trying to make some sense of the cosmos as they saw it. Prehistoric Astronomy Fast forward about 10,000 years to the time of the first civilizations, and the earliest astronomers who already figured out how to use the sky. In some cultures, they were priests, priestesses, and other elites who studied the movement of celestial bodies to determine rituals, celebrations, and planting cycles. With their ability to observe and even forecast celestial events, these people held great power among their societies. This is because the sky remained a mystery to most people, and in many cases, cultures put their deities in the sky. Anyone who could figure out the mysteries of the sky (and the sacred) had to be pretty important.   However, their observations were not exactly scientific. They were more practical, although somewhat used for ritual purposes. In some civilizations, people assumed that that celestial objects and their motions could foretell their own futures. That belief led to the now-discounted practice of astrology, which is more of an entertainment than anything scientific.   The Greeks Lead the Way The ancient Greeks were among the first to start developing theories about what they saw in the sky. Theres much evidence that early Asian societies also relied on the heavens as a sort of calendar. Certainly, navigators and travelers used the positions of the Sun, Moon, and stars to find their way around the planet.   Observations of the Moon suggested that Earth, too, was round. People also believed that Earth was the center of all creation. When coupled with the philosopher Plato’s assertion that the sphere was the perfect geometrical shape, the Earth-centered view of the universe seemed like a natural fit.   Many other early observers believed the heavens were really a giant crystalline bowl arching over Earth. That view gave way to another idea, expounded by astronomer Eudoxus and philosopher Aristotle in the 4th century BCE. They said the Sun, Moon, and planets hung on a set of nesting, concentric spheres surrounding Earth. Nobody could see them, but something was holding up the celestial objects, and invisible nesting balls were as good an explanation as anything else. Although helpful to ancient people trying to make sense of an unknown universe, this model did not help in properly tracking the motions planets, the Moon, or stars as seen from Earths surface. Still, with few refinements, it remained the predominant scientific view of the universe for another six hundred years. The Ptolemaic Revolution in Astronomy In the Second Century BCE, Claudius Ptolemaeus (Ptolemy), a Roman astronomer working in Egypt, added a curious invention of his own to the geocentric model of nesting crystalline balls.   He said that the planets moved in perfect circles made of something, attached to those perfect spheres. All that stuff   rotated around Earth. He called these little circles epicycles and they were an important (if erroneous) assumption. While it was wrong, his theory could, at least, predict the paths of the planets fairly well. Ptolemys view remained the preferred explanation for another fourteen centuries! The Copernican Revolution That all changed in the 16th century, when  Nicolaus Copernicus, a Polish astronomer tiring of the cumbersome and imprecise nature of the Ptolemaic model, began working on a theory of his own. He thought there had to be a better way to explain the perceived motions of planets and the Moon in the sky. He theorized that the Sun was at the center of the universe and Earth and other planets revolved around it. Seems simple enough, and very logical. However, this idea conflicted with the Holy Roman churchs idea (which was largely based on the perfection of Ptolemys theory). In fact, his idea caused him some trouble. Thats because, in the Churchs view, humanity and its planet were always and only to be considered the center of all things. The Copernican idea demoted Earth to something the Church didnt want to think about. Since it was the Church and had assumed power over all knowledge, it threw its weight around to get his idea discredited.   But, Copernicus persisted. His model of the universe, while still incorrect, did three main things. It explained the prograde and retrograde motions of the planets. It took Earth out of its spot as the center of the universe. And, it expanded the size of the universe. In a geocentric model, the size of the universe is limited so that it can revolve once every 24 hours, or else the stars would get slung off due to centrifugal force. So, maybe the Church did fear more than a demotion of our place in the universe since a deeper understanding of the universe was changing with Copernicuss ideas.   While it was a major step in the right direction, Copernicus’ theories were still quite cumbersome and imprecise. Yet, he paved the way for further scientific understanding. His book, On the Revolutions of the Heavenly Bodies, which was published as he lay on his deathbed, was a key element in the beginning of the Renaissance and the Age of Enlightenment. In those centuries, the scientific nature of astronomy became incredibly important, along with the construction of telescopes to observe the heavens. Many of them believe that what they are doing is not wrong and that having sex with a child is actually healthy for the child. Almost all pedophiles have a collection of pornography, which they protect at all costs. Many of them also collect souvenirs from their victims. They rarely discard either their porn or collections for any reason. One factor that works against the pedophile is that eventually the children will grow up and recall the events that occurred. Mergers produce synergies and economies of scale, increasing operations and cutting prices. Investors will take comfort within the idea that a merger can deliver increased market power. The same thing happens with the Americas biggest merger deal between AOL and Time Warner. They think that merger is helpful for both the companies but it not matched for both of them. Both AOL and Time Warner synergies shows diversification is that the main goal of the firms to extend the revenue and to attain the value gain because of the amendment in mode of technology and increase in the competition for the well established firms. Throughout the phase of merger web bubbles also the main cause for over valuation of shares. In distinction Time Warner was the victim of net bubble. This type merger failure cases shows support the European Comm ission to restrict the American companies to merge with the European companies. European commission has a right to govern the European market and make stable the Euro Zone market. The European commission (EC) is thought of defending domestic companies from foreign rival and they encourage their zone mergers. So the European commission doesnt want any problems like dis-economies of scale, clashes of cultures and reduction of flexibilities by the merger of American companies. So the merger is highly regulated by European Union to avoid major concentration of economic power in euro zone. Although the terms merger and acquisition are used very closely, but they are different. When one company takes over the other, the target company is taken as non-existent and the buyer company takes over the company continues to trade the stocks with its name. Whereas, in case of mergers, two separate firms, mostly of the same size, mutually agree to go forward with an entirely single new company with respect to the operations and owning of the new firm jointly rather than two separate firms. The case is about the merger of British Airways and Iberia making them to catch up on their rival Air Carriers and compete with the low-cost airlines, rising fuel costs, security concerns and costs for customers. However, due to commercial purposes, both the Airways would retain their existing brands. Both the companies look forward to gain from the merger with respect to a greater access across America. For the miracle worker, William M Walsh, who announced the planned merger, after a difficult year for British Airways, due to Icelandic Volcanic Ash Clouds and Cabin Crew strikes, situation has become even more trouble-some with the kind of response British Airways has been receiving from the BASSA (British Airline Stewards and Stewardesses Association), Unite Union, BALPA (British Airline Pilots Association) and their own staff. Though the travel analysts believe that the merger would on a long run prove to be beneficial for travelers or customers, but the concern right now for British Airways is to re-convince the BASSA (British Airline Stewards and Stewardesses Association), Unite Union Leadership who have changed their mind to settle for the new changes taking place. On the other hand, the media and the staff including BALPA (British Airline Pilots Association) are also at unrest due to the new proceedings taking place. Now the problem which Tom McCarthy, the retiring HRM Director of British Airways is trying to resolve is how the British Airways can settle the industrial unrest. As clearly stated, the industrial unrest is caused due to the merger with Iberia, and also the proposed plans of pay-cuts, redundancy, job losses and retaining the best talent pool and change in working conditions. Unite union, after the shareholders meeting, have announced to ballot the choices of cabin crew, whether to or not to take any further industrial action. However, on the other hand, BASSA (British Airline Stewards and Stewardesses Association) is also seeking a ballot for carrying out a strike against the British Airways. If I was asked to determine, how the British Airways could manage the rounds of Industrial Action, my first step would be to call for a meeting with the British Airways Carriers Management, the complete management representatives, representatives from the Unite Union, from BASSA (British Airline Stewards and Stewardesses Association), from BALPA (British Airline Pilots Association) and the staff. Since, this merger was planned, the expected output with respect to revenue is profitable, the concerns of the manpower cannot be ignored. Thus, a consultative meeting with the purpose of Collective Bargaining could be planned and called. Collective Bargaining can be used as a term for voluntary negotiation between the employer, employee or the trade union. The purpose of collective bargaining is to reach at a mutual agreement with respect to the work and the working conditions. Since, the purpose would be to negotiate, the management would point out the benefits of the mergers and the reasons for the decisions that could or would be taken due to the same. The discussion, on the other hand, give a chance to the other side of the employer, to put their view-point forward and also, come up with suggestions that could ease out the unrest amongst the staff and their associations. The steps that could facilitate a better response from the employees, other than a collective meeting for negotiation could be holding department wise meetings, encouragement of written communication, placing of suggestion box at various areas for the employees. As a second step, I would have to draft the expected Human Resource challenges that the British Airways would face due to the industrial unrest caused by the merger. During a merger, the human capital, i.e., the employees are scrutinized other than financial and material assets of any company. The staff, across levels become insure about their job. They fear demotion, decreased salaries and even continued employment. The main Human resource challenge faced is to decide how many employees would be affected and what would be the time line for the same. The issue of taking such decisions requires a good and clear communication that is free from any kind of rumors. In mergers, mostly one or few among the available are taken, either the company proposes downsizing, wherein, the decision is taken to let the personnel go for improving their efficiency or lay-offs, wherein, the termination takes place, either of employees or of positions. The decision for such affair is taken by the dominant company and thus, the HR needs to follow a professional approach towards planning a fair method of lay-off implementation. Another issue is to assimilate the new employee with the old after the merger. The introduction and assigning of team to facilitate team work would have to be done with great planning and care. Also, as discussed earlier, the concern which is faced by the British Airways is the resistance to change by the employees. With a proper channel of communication, suggestion boxes etc, this problem can also be worked out and sort a solution for. For any merger to be successful, it is imperative, that the manpower, the people involved, who drive the business and its growth are capable of creating, innovating and executing things collaboratively. The employees should be able to understand, why such an action is taken by the management and what benefit it would produce for them. They should be able to relate the value , the merger would bring to their daily work life. The challenge here is that the management should not act as an administrator but a coach or profit consultant. The Human Resource department here should focus on easing the merger transition and fitting the pieces as closely as possible. It should initiate in areas other than just administration or payroll but work closely together with the management in recruitment, retention and managing the effects of cultural change. The people may also be resistant to change because they might have to work in a different process, different department, different geographical location other than a different team, management and new members. The HR should take up these issues seriously as it might result in walk-outs also, as in the case of British Airways where BASPA is planning for a strike ballot, where around 10,500 workers may walkout. The possible solutions or potential HR strategic plans should be drafted. The management could give time to the employees to build trust amongst all the new people, the environment and the changes introduced. Both the companies should appoint an integration team, which would include the Human Resource team to meet periodically to plan the changes and execute the same at the acquired firm. The HR team of the dominant company would have to learn about the acquired company, its business and the people working in it. The approach to be followed should be of participative nature and not dominative. Like in British Airways, where it has been clearly agreed by Walsh, that the jobs would be lost, cost cutting would be exercised, and employees may be asked for voluntary redundancy other than pay-cuts for cabin-crew. On the other hand, Iberia also plans to freeze their hiring plans and also request for early retirement of many of its employees. Measure should be take to be taken to address the concerns of the employees, by mean of an open communication, there could be a hot-line for the employees where they may call and and confidential seek answers to their queries , since many employees may not want to put their foot forward in public. The purpose should be to encourage the employees to meet their new counterpart and companions. The Human Resource team should focus and aim at introducing and familiarizing the new teams and new set of people with each other, as these people are insecure and worried about their jobs and future. With British Airways and Iberias merger, the possible areas of conflict and resistance that may arise in the transitional period of replacing old crew with new crew. The transitional period bring with it a lot of anxiety, rejection, self-protectiveness, this was not hoped for response for the new management, defensiveness etc. The employees may not be ready to work with people they do not think they will be able to be friendly with. Since, the feeling and anger of losing their friends, who because of the merger, might have been laid off or downsized. The staff members may not want to work under the new policies and practices laid down by the new management. They may also be resistant to change their location or department of work. During transition, employees may feel displaced, low on energy, may resent to learn new things, may lose focus. People during such time , want their normal days to return as quickly as possible. They at such times have an amplified need for predictability, control and protection. An aggrieved employee would look for visible leader, accessible management Whenever an organization makes a change, its people have to deal with, first an ending or letting go of what was; then a time between the old and the new when the person is a drift called the neutral zone, and then a new beginning or reintegration. (Bridges, 1991). When we talk about a training program, we analyse the need for such a program on the first place. Since, here it is a matter of merger of two companies, where other than many changes, one change is about the working of the new company, its management, its policies and the planned practices. The training programme should be designed to serve the purpose of filling the gap between, what is know, may be through mouth of word, or as a rumor and to let people know the truth or the facts. The training program should be designed to address the issues of the employees concerned. Since, the company formed is new, it would have to address the concerns relating the working style and the management, the people in the management etc. It should focus on introducing the new formulations, rules, regulations, and peole in the company.
